Obama reminded an audience in Colorado that opponents of Social Security in the 1930s "said that everybody was going to have to wear dog tags and that this was a plot for the government to keep track of everybody ... These struggles have always boiled down to a contest between hope and fear." True enough. There was McCarthyism in the 1950s, the John Birch Society in the 1960s. But there was a difference in those times: the crazies were a faction — often a powerful faction — of the Republican Party, but they didn't run it.

September 2002 CIA briefing that Nancy Pelosi received about enhanced interrogation techniques, it seems clear that she was given enough information to conclude that we either had already conducted waterboarding and other harsh techniques, or that we very well might in the near future.
So the more important question, which seems to be getting less attention today, is what Pelosi did in response. And the short answer appears to be: very little.

But the Obama DOJ demanded dismissal of the entire lawsuit based on (1) its Bush-mimicking claim that the "state secrets" privilege bars any lawsuits against the Bush administration for illegal spying, and (2) a brand new "sovereign immunity" claim of breathtaking scope -- never before advanced even by the Bush administration -- that the Patriot Act bars any lawsuits of any kind for illegal government surveillance unless there is "willful disclosure" of the illegally intercepted communications.

Whatever one's views are on the abstract 9/11-anthrax comparison, there is no question that the anthrax attacks were a major political crime. According to the FBI, the anthrax letters were directed at U.S. Senators (Leahy and Daschle) due to their political views (specifically their opposition to the Patriot Act, their allegedly "soft on terrorism" approach, and their pro-choice views). And perhaps most importantly, the anthrax attacks -- again, according to the FBI itself -- came from a U.S. Army laboratory, perpetrated by a U.S. Government scientist.
